HOW TO TAKE CARE OF A BUILDING CODE VIOLATION

It is important to get your building code violation cleared as soon as you are hit with one. The first step towards this is to correct the specific structural anomalies on your property that falls outside the approved building code in the city where you live.

Keep in mind that building violations are not just for apartments, lofts, condos and other types of apartment buildings. Every other type of structure ranging from hotels to factories and office buildings are also required to follow the city’s building code and therefore building violations can be issued for them when they are found to be in contravention.

If you are clueless about the type of renovation necessary to get your building violation cleared then you can get in touch with inspection officers of the Borough Code Enforcement Agency under the Housing Development & Preservation Department. These officers will provide you with the necessary technical advice to make the necessary structural corrections. Once you complete the necessary changes, the next step will be to file a Dismissal Request form at the Code Enforcement office of the borough where the building is situated in. You will be required to pay certain fees when filing the form. A Code Enforcement inspection team will then be sent to analyze the new changes made in your building to ensure that they fall under the city’s building code before the violation can be cleared.

 

HOW TO REPORT A VIOLATION

Apart from making sure that your existing building code violations have been cleared, it is the responsibility of every resident to report a building that violates the code. You can do this by either visiting the office of the Borough Code Enforcement Agency or Calling 311 to inform the relevant authorities of a building violation. You can alternatively log onto the web and make a report on the Department of Building website or on the 311 website.  If you are a tenant living in an apartment that violates the New York building code then you should not hesitate to make a report. Whether you are experiencing drainage problems or facing lighting issues, make sure you submit a report if your landlord has refused to make the necessary renovations.  Insect infestation problems, inadequate windows, inadequate room spacing, etc. are other common building violation reports submitted by some tenants. Taking this step will be in your best interest as it will help ensure your safety at home while improving the quality of life you enjoy in your apartment.
