HOW TO OBTAIN A BUILDING PERMIT IN NYC

The New York Department of Buildings requires that every homeowner seeks a building permit for any new construction project ranging from new buildings to renovations of old structures. Homeowners are also required to seek permits before condemned or dilapidated buildings are demolished to make space for new ones. New York City has strict building codes just like those of other cities in the United States and every home in the City is required to adhere to these codes in order to ensure the safety of residents. The purpose of obtaining a building permit before any project goes underway is to ensure that new homes as well as old ones continue to adhere to the city’s building regulations.

FAQ - Frequently Asked Questions

WHAT IS A Building Violation?

Unlike a parking ticket, a building violation notice is something that not only requires you to pay a fine, but may also require an action of physically correcting the problem. Sometimes, a violation can be resolved without a fine or even dismissed. It is recommended that a property owner hires a BUILDVIO team of licensed professionals, Registered Architect and professional Expeditors to receive an accurate evaluation of the violation charges.

However, one must know that a Building Violation is not the source of the problem. It's the repairs or corrections that must be made to avoid more fines and penalties.

General Explanation:

Building Violation is a violation of a Building Code - in essence a design standard, adapted by your local Building Department (also known as Department of Buildings.) The goal of adapting these standards is ensuring life safety and quality of life for building inhabitants. Being that the most feared danger for a building is a fire, most codes stem from methods directed at preventing an occurrence of a fire and successful conditions for fighting a potential fire hazard.

There are two agencies that currently are considered most authoritative on Building Codes. They are ICC (International Code Council) and NFPA (National Fire Protection Agency).

In turn, they heavily rely on several materials testing organizations such as UL (United Laboratories) and ASTM International (ASTM), originally known as the American Society for Testing and Materials. Predominantly, the IBC (International Building Code) is the most adopted design standard in United States. However amended versions of IBC or other codes may be enforced by your local municipality.

  IS BUILDING VIOLATION A CRIME?

Every so often we hear stories about imprisoned homeowners or developers. This usually happens when someone gets hurt. Building Violation is a life-safety hazard. Therefore a violation of a Building Code is considered a crime punishable by law. A punishment for a Building Violation may be a fine, but building violations may also lead to a jail sentence.

In such severe cases, person may negotiate a higher fine to replace an incarceration, but if there was a loss of human life due to negligence than an incarceration is immanent.

Always, a violation must be resolved physically by deconstructing or constructing a space to address the subject of violation, according to adopted design guidelines.

In case of ongoing construction, a violation may result in a Stop Order.

An example of such violation would be "Work Without Permit". The same violation may also apply to situation when a structure as minimal as a deck or as large as whole building was constructed without filing plans and receiving approvals from local building authorities.

These things may have been grandfathered in to your property when you bought it, this is why you need BUILDVIO team to look up your violation and compare with existing code.

[Note: permission to build by a community board or a land lord does not constitute a Permit to build. You must obtain applicable permit from your local municipal Building Department]

In both instances a punishment would be a fine and order to demolish the structure or file plans and obtain approvals. In case of criminal negligence a criminal attorney with experience in construction should always be consulted. In other situations, an Architect or an Expeditor may advise you on how to avoid a stiffer punishment.
