New York does not have one local building department for every property. Outside New York City, code administration and enforcement may be handled by a city, town, village, county, or another authorized local authority. New York City operates its own Department of Buildings and related enforcement systems.
For NYC properties, a DOB violation identifies noncompliance with applicable construction, zoning, or other requirements. An OATH summons is an enforcement summons returnable to the Office of Administrative Trials and Hearings. Depending on the matter, resolution can involve correction of the condition, permits or inspections, an OATH hearing or other disposition, applicable penalties, and proof or certification of correction.
Important: Paying an OATH penalty does not necessarily close the underlying violation. NYC DOB states that a summons can continue to appear open until it is dismissed at OATH or resolved through the correction process.
