By opening an account on our website or by clicking to accept or agree to the Terms of Service, you accept that without duress you have read and understood all terms and conditions, and accept and agree, on behalf of yourself or on behalf of your employer or client or any other entity (if applicable), to be bound by these Terms of Service and Building Violation Payment Terms, found here (“Payment Terms”), which is incorporated herein by reference. You further acknowledge that you have read and understood our Privacy Policy, found here. If you do not agree to these Terms of Service or the Privacy Policy you must not create an account on the Site. This agreement is final and cannot be waived if an account on the Site has been opened. If you are reading this, by using our website, you agree to the following terms and conditions of service ("Terms of Service''), which from now on shall govern your access to and use of the Building Violation website and mobile application, including any content, functionality and services offered on or through www.BuildingViolation.com or the Building Violation mobile application (the "Site") by Building Violation LLC (2040 NE 163rd Street 202D North Miami Beach FL 33168 and its subsidiaries as applicable. Building Violation LLC and its subsidiaries are collectively referred herein as "BuildingViolation" "we" or "us" and “you” or “user” means you as an user of the Site.

By using the Site you agree that you are at least 18 years of age and of legal age to form a binding contract. If you are under 18 you are not permitted to use the Site or the Building Violation services. By using the Site, you represent and warrant that you are of a healthy state of mind and meet all of the foregoing eligibility requirements. If you do not meet all of these requirements, you must not access or use the Site.

The original language of these Terms of Service, as well as all other communication throughout the Site, is English. Any translation or use of other languages is available for your convenience only. In case of a conflict in translation the English version shall prevail.

Key Terms

Building Violation is a non-compliance that exists contrary to accepted municipal and county ordinances, state laws, and national and international construction codes, which has been discovered through an investigation by a state, county, or a municipal official, and which resulted in an order issued to an owner of the property, who is identified as a respondent, to correct the violating condition and certify its correction prior to a date of a hearing, which is adjudicated by a local magistrate or a county official.

Open Requirements are actions that are the responsibility of an owner of the property that are necessary to correct the violating condition, to be able to receive a Redemption.

Redemption is receiving a resolved status for a building violation from the agency that investigated the complaint and determined the property condition is in-violation; And is the only final product that can be purchased on BuildingViolation.com.

Delivery of Redemption may include administrative and physical labor that may consist of, but not limited to, obtaining permits, physical labor, attending hearings, and mitigation of fines and penalties imposed by the government, and other actions, which are outlined, reviewed, accepted, and purchased through Redemption Offer on BuildingViolation.com and in concert with satisfaction of all open requirements delivers the purchased Redemption.

Respondents are Buyers, who are registered accounts on the website that purchase Redemption on BuildingViolation.com.

Pros are Sellers who are registered accounts on the website that provide Redemption to Respondents in real life, by delivering the purchased product through a resolved status of the Building Violation.

Account is an interface-profile available only to registered users that allows them to interact and transact with other users on the website. Account may be of two separate types: Respondent and Pro.

Team Member is any user that is invited or uses a Pro Account.

Redemption Offers are exclusive proposals that a Pro can create in response to specific requirements to provide Redemption to the Respondent.

Custom Orders are requests made by a Respondent to receive a Custom Offer from a Seller.

Order Page is where Buyers and Sellers communicate with each other in connection with an ordered Redemption.

Orders are the formal agreements between a Buyer and a Seller after a purchase was made from the Seller’s Order Page.

Conditions of Service

BuildingViolation.com is NOT a government entity and does not issue the Building Violations that it resolves. Registration is free and without duress. Only users that register an account may buy and sell on BuildingViolation.com. You are solely responsible for any activity on your account and for maintaining the security and confidentiality of your password. In registering for an account, you agree to provide us with accurate, complete and updated information and must not create an account for fraudulent or misleading purposes. We are not liable for any acts or omissions by you in connection with your account.

Redemption offer on BuildingViolation.com is determined and prepared by the Seller; And offered at a local competitive market price directly to the Buyer through an account user interface, available only to registered accounts.

Buyers pay BuildingViolation.com in advance to create an order which immediately initiates delivery of Redemption. (see Payment Terms). Our Redemption order may be used as proof of good moral character, and intent of compliance, and commitment to attain compliance, which may be required by association boards and other public review committees.

Orders are purchased through the Order button located on a Redemption Offer page or through a Payment Page.

Sellers must fulfill their orders, and may not cancel orders on a regular basis or without cause. Canceling orders will affect Sellers’ reputation and status. Seller takes final responsibility for damage caused to Buyer by the Seller's actions of error or omission; and promises to maintain a general liability insurance that shall have Building Violation LLC included in terms of the insurance policy. A copy of the general liability insurance policy must be emailed to info@buildingviolation.com right after registering a new Pro account on the website.

Users may not offer or accept payments using any method other than placing an order through BuildingViolation.com or by calling (866) 545-4440 and receiving an electronic check payment form from Building Violation LLC.

When purchasing a Redemption, Buyers are granted all rights for the delivered work, unless otherwise specified by the Seller on their Redemption Offer page.

Building Violation LLC retains the right to use all published delivered works and Logo Designs for BuildingViolation.com marketing and promotion purposes.
