Attention!!! - Daily Penalties!!!

 

Violation of §28-210.1 of the Administrative Code (illegal conversion) prescribes additional penalties of $1000 per day for each day the violation remains uncorrected (45 days maximum). This additional penalty is added to the standard penalty for illegal conversion.

 

To stop maximum daily penalties before first hearing, a certificate of correction must be submitted and approved prior to the hearing. A hearing must be scheduled, immediately, to avoid default and the additional maximum daily fines.

 

At the hearing, a Certificate of Correction Approval Letter will be presented so that an Administrative Law Judge can access appropriate daily penalties.

Ilegal Conversion F.A.Q.

- illegal conversion is a violation of the Administrative code of New York City, which is an alteration or modification of an existing building to create an additional housing unit without a permit from New York City Department of Buildings. 

Illegal conversion may include creating additional basement apartment, or cellar apartment; efficiency, illegal appartment share, illegal hostel, airbnb, or simply living as more than one family in a single family dwelling. 

  • Examples of illegal conversions include:
  • Using a property zoned for manufacturing or industria use for residential occupancy;
  • Creating a housing unit in a building designated for manufacturing or industrial use;
  • Adding an apartmentin the basement, attic or garage without obtaining approval or permits from the Department of Buildings; or
  • Creating a rooming house (single room occupancy) or dividing an apartment into single room occupancies.

Each square foot of a dwelling unit is calculated to allow for light, air, and life safety. Illegal modifications can cause health hazzard and threaten quality of life and efficient fire rescue. 

Local Law 37 of 2007

In August of 2007, Mayor Michael Bloomberg signed Local Law 37 in to law. The new law increased the penalties for illegaly converting manufacturing or industrial space to a residential use. Coupled with changes to the ECB violation system implemented in July 2008 with the enactment of the NYC Construction Codes, the maximum penalties for a violation now can be as high as $25,000
