Timely Certification of Correction
If an eligible violation is still within its certification period, the owner can correct the cited condition and submit the required certification through HPD's applicable paper or electronic process.
Clearing an HPD violation can involve more than making the repair. The correct closeout path depends on the current HPD record, the violation type, whether the certification period is still open, and whether special documentation, reinspection or a Dismissal Request is required.
At intake, Building Violation LLC identifies the property, relevant HPD record and any immediate timing issue from the information available. If project-specific research, correction, filing, inspection or closeout work is needed, we define the applicable scope and fee before detailed technical work begins.
HPD eCertification is a free agency process for eligible violations, but it is not the same as professional violation-resolution assistance. The cited condition must actually be corrected, the building must meet HPD eligibility requirements, and some violation types require paper forms or special supporting documentation instead of routine eCertification.
A current property registration is required for eCertification eligibility. Lead violations are not eligible for eCertification; HPD also directs mold and pest certifications through special procedures.
HPD uses different clearance procedures depending on the violation, its status and whether the correction was certified within the applicable period. A violation that remains within its certification period may qualify for Certification of Correction, while an older or unsuccessfully certified violation may require a Dismissal Request, reinspection, documentation submission or another HPD clearance procedure.
If an eligible violation is still within its certification period, the owner can correct the cited condition and submit the required certification through HPD's applicable paper or electronic process.
When a violation was not timely certified, or a certification was found false, HPD may require a Dismissal Request and reinspection before the record can be dismissed. Other status-specific procedures can apply.
Certain HPD violations—including lead-based paint, mold and pest conditions—have special certification and documentation procedures. These violations should not be treated like routine eCertification matters. Review the applicable Notice of Violation and current HPD instructions before filing.
Physical repair does not always remove the violation from the HPD record. Certification, documentation, reinspection or another closeout step may still be required.
An older violation may require a Dismissal Request, reinspection, documentation submission or another HPD procedure.
Review the violation record and correction documentation before attempting another submission.
Certain HPD violations have special documentation and certification procedures and should not be handled like ordinary maintenance violations.
Where HPD, DOB or OATH matters overlap, the work can be coordinated around the property record rather than treating each issue in isolation.
HPD violations have different correction and certification periods depending on the violation class and condition involved. Lead-based paint, window guards, heat/hot water, mold, pest conditions and certain other violations may follow special requirements. Review the Notice of Violation and current HPD record before relying on a general deadline.
HPD does not charge owners to submit an eligible Certification of Correction. Professional assistance becomes valuable when the matter requires project-specific record review, correction planning, documentation, coordination, inspection strategy or government-record closeout.
Depending on the authorized scope, assistance may include:
The applicable scope depends on the property and violation record. No particular agency acceptance, dismissal, approval or outcome is guaranteed.
A Certification of Correction should be submitted only after the cited condition has actually been corrected and any required supporting documentation is available. HPD may audit certifications. If the condition remains uncorrected or required documentation is missing, determine the appropriate next step rather than submitting an unsupported certification.
Certain HPD violations—including lead-based paint, mold and pest conditions—have special certification and documentation procedures. These violations should not be treated like routine eCertification matters. Review the applicable Notice of Violation and current HPD instructions before filing.
Current property registration may be required for eCertification eligibility.
Correcting the physical condition does not necessarily remove the violation from the HPD record. The applicable certification, documentation, inspection or dismissal procedure must also be completed.
Failure to properly correct and certify certain HPD violations can result in civil penalties, inspection fees or additional enforcement. If repairs were completed but the violation still appears open, review the current HPD record before assuming the matter is closed.
